Case 1: Private Lending Dispute —Determination of Liability Where a Legal Representative Borrows Personally for Company Operations:
In the private lending dispute brought by Plaintiff Z against Company A, Company B, and individuals C and D, the issue concerned the determination of liability where a legal representative borrowed funds in his personal capacity for use in company operations. The court of first instance ruled in favor of the plaintiff, awarding the full principal and interest, totaling approximately RMB 16.36 million.
Case 2: Recovery of Minors' Live-Streaming Tips (Online Service Contract Dispute) —With the Ximalaya Platform as Defendant
The operator of the Ximalaya platform, as defendant, returned the majority of the tipped funds, while the minor's mother voluntarily bore the remaining minor portion of the loss. The case was concluded through mediation, and all payments were fully performed.
Case 3: Liquidation Liability Dispute —A Loan Intermediary Collected Substantial Service Fees and Then Deregistered to Evade Debts
Ruling: The defendant shareholders, Z and L, were ordered to refund RMB 60,000 in service fees to the plaintiff (the amount was reduced in part because the plaintiff had actually obtained a portion of the loan facility), and to bear the case acceptance fee.
Case 4: Corporate Retained Legal Counsel —Risk Items Identified in the Annual Compliance Review and Their Resolution
A certain company engaged the firm as its retained legal counsel. During the annual compliance review, the following risk items were identified: (1) hidden risks arising from nominee shareholding; (2) uncontrolled related-party transactions; and (3) defects in corporate resolutions. The counsel issued a special compliance report on the above matters and proposed a rectification plan. Subsequently, a creditor of L applied to enforce the nominee-held equity, and the company and W, acting on the counsel's advice, filed an action of objection to enforcement; meanwhile, Z filed an action to revoke the corporate resolution. The counsel represented the company and W in the action of objection to enforcement.
Case 5: Lease Contract Dispute —Where the Contractual Lessee Differed from the Actual User, the Actual Lessee Was Successfully Joined to Bear the Debt
The court ordered Defendant C and Defendant Company Z to jointly and severally pay the plaintiff outstanding rent and premises occupancy fees totaling more than RMB 600,000. After the judgment took effect, the bank account in the name of Company Z was frozen, the full amount was enforced and recovered, and the plaintiff successfully collected the debt.
Case 6: Batch Case Legal Services —Full-Process Disposal of Overdue Credit Card and Consumer Loan Claims
As the scale of overdue personal credit card and consumer loan business continued to rise, the team handled a batch of overdue claims. Of the more than 300 cases in the batch, approximately 180 were concluded through pre-litigation mediation plus judicial confirmation; over 90% obtained enforceable instruments within six months; and in the subsequent enforcement stage, through account freezing, deduction of deposits, and initiation of appraisal and auction procedures against debtors owning real property, the cumulative recovery rate was significantly higher than that of self-collection.
